Who we are: Brian Mole Independent Financial Advisers Ltd. is a Limited Company registered in England and Wales (registration number 02918076) whose registered address is Independence House, 26 Bridge Street, Burton on Trent, Staffordshire DE14 1SY. The firm is authorised and regulated by the Financial Conduct Authority, and is entered on the Financial Services Register under reference number 211978.

Why we need your details: Brian Mole IFA Ltd. will collect and use your personal details, which may include on occasions ‘sensitive’ personal data, so that we may carry out any one or more of the following:

• To provide you with financial advice
• To reply to any requests for information that you may make
• To clarify any particular queries you may raise
• To supply you with details of any products or services that we believe may meet your needs
• To cross-check and validate any information that we may receive with that held on our database and/or in our records

How we receive the information: Any information that we may obtain and hold about you will ordinarily be supplied by you directly to us in a face to face meeting, by telephone or via e-mail. We class this as being ‘personally identifiable information’, which means it can be used to identify you personally.

Use and storage of your personal information: When you supply any personal information to us we have legal obligations towards you in the way we use this data. We must collect the information fairly – that is to say, we must explain how we will use it and tell you if we want to pass that information on to anyone else. Primarily, we use the data to provide financial advice to you and to complete transactions on your behalf. We will also analyse and assess your data to maintain and develop our relationship with you.

Depending on the instructions we receive from you, we may on occasions need to pass your data to other professional advisers to enable us to provide advice most suited to your circumstances. Usually this would for example entail referrals to accountants, solicitors, tax advisers, and sometimes specialist advisers in the financial services and insurance industry, where you may benefit from the expertise of such third parties. We, and any third-party specialist advisers to whom we may introduce you, will pass your data to organisations when you agree to purchase and amend policies and products. We will hold your personal information on our systems for as long as you use the service you have requested. For instance, if you are given specialist pension advice, the data will be retained indefinitely. We will ensure that all personal information supplied is held securely, and in accordance with the relevant Data Protection legislation. We may be required to share your data with our Regulator (the Financial Conduct Authority) and other third parties including auditors or insurers.

We will not contact you for promotional purposes, such as notifying you of improvements to the service or new services, unless you specifically agree to be contacted for such purposes.

Who has access to this information? Your personal information/data will be kept within the firm’s records until such time as we decide that they should be removed. Your details will not be sold to any third party.

How secure are your details? When you provide us with your personal information/data we will take all reasonable steps to keep these details secure and free from unauthorised access by use of technology and internal systems which will be updated as new technology becomes available, and which is appropriate to our systems.

Withdrawal of consent: Where we process your personal data we do so on the basis that you have provided your consent for us to obtain, hold and process that data for the purposes of providing our services to you as agreed when you submitted your personal data to us. You may withdraw your consent to this processing at any time by contacting the Data Protection Officer at our registered address as noted above, or on 01283 512252.

If you decide to withdraw your consent, please be aware that due to our Regulatory obligations and legal responsibilities there may still be occasions where we are unable to delete our records, and may still be able to process some of the data you have provided. This will be on grounds other than ‘consent’, and we will notify you of these at such time.

Removing or changing your information: If you wish us to remove or amend any data that we hold on you, or correct any errors in that data, again please contact the Data Protection Officer at our normal business address noted above or on 01283 512252.

Your information rights: Data Protection legislation gives you the right to access information held about you. You are entitled to be told by us whether we or someone else on our behalf is processing your personal information, what personal information we hold, details of the purposes for the processing of your personal information, and details of any third-party with whom your personal information has been shared.

You can access the personal information we hold on you by writing to the Data Protection Officer at our address noted above. We will ask you to provide proof of identity before we show you your personal information, and this is so that we can prevent unauthorised access.

Please note that for any access request made after 25 May 2018 that is deemed excessive, or especially repetitive, we may charge a ‘reasonable fee’ for meeting that request. Similarly, we may charge a reasonable fee to comply with requests for further copies of the same information. That fee will be based upon the administrative costs of providing the information.

You are also entitled to receive the personal data that you have provided to us in a structured, commonly used and machine-readable format, and to transmit that data to another data controller.
